PUC candidate Wayne Schmidt's objectives as a Public Utilities Commissioner

Wayne Schmidt has 3 important issues he will begin focusing on as your next Public Utilities Commissioner.  He has also taken a stance on the Keystone XL pipeline.


  • He will work with the State Legislature on the need to begin a PUC investigation as to why city utilities are continually charging out-of-town customers extra money for services long after the initial expense of installing those services has been paid.
  • Wayne believes in a free market system and will push for the ability of customers to choose which company provides their electric service.  The break-up of Ma Bell 25 years ago encouraged competition and more competitive rates for phone service.   Wayne will look into why we can't allow more choices for our power and gas services.
  • He has come out against the Keystone XL pipeline stating that it appears there is no benefit to South Dakotans.

Alternative Candidates Forum and Town Hall






All Independent and 3rd Party candidates are invited to attend an Alternative Candidates Forum & Town Hall on Saturday, Aug. 23rd in Sioux Falls at the main library located at 200 N. Dakota Ave.

Program starts at 1:30, participating candidates should arrive at 1:00pm.  Each candidate will have 10 minutes to speak and then the rest of afternoon will be dedicated to voters asking questions of the candidates.

Wayne Schmidt of Mobridge for Public Utilities Commissioner and Lori Stacey of Sioux Falls for her second run for Secretary of State won their nominations by unanimous vote.

Constitution Party of South Dakota State Convention 2014

The Constitution Party of South Dakota will be holding its state convention on Saturday, June 21st in Sioux Falls.  This fun and informative event takes place in meeting rooms A & B of the main library located at:  200 N. Dakota Avenue in Sioux Falls.

The event will start at 10:00 am and admission includes a catered lunch.  A limited number of vendor tables will also be available to showcase your small business or services, set-up will start at 9:00 am.

We are excited to be bringing back Constitutional Attorney Richard D. Fry to South Dakota.  This time, he will be giving a presentation called, "The Dirty Dozen: The Twelve Concepts Every Public Officer Should Know".  Mr. Fry will be covering all the bases with great information. CP members and the public are welcome to join us!

The Twelve Concepts Every Public Officer Should Know

Extra-Constitutional Concepts

  1. Sovereignty and its inherent authority.
  2. The primary purpose of any legitimate government.  
The Constitution
  1. The fact that the Constitution was written for the “average voter” or the "average citizen.”
  2. The Purpose and scope of the Constitution.
  1. The only federal court that has the authority to hear a case in which a state is a party is the U.S. Supreme Court. (Article III §2 cl. 2)
  1. A constitutional convention cannot be controlled and should be avoided at all costs.   (Article V.)
  1. The extent and meaning of the Supremacy Clause. (Article VI, Clause 2)
  1. The extent and meaning of the "Oath Clause".  (Article VI, Section 3)
  2. The myth of "State Nullification" vs. Constitutional Nullification.
Principles of Federalism
   10.  State courts have concurrent jurisdiction with the "lower“ federal courts to                               decide and interpret federal laws and the Constitution within their territorial                             boundaries.
   11.  The Federal government cannot require a state to:
  • Pass specific legislation
  • Participate in a particular federal program ("scheme")
  • Administrate a federal program ("scheme”)
  12.  Federalism is meant to directly protect the citizens.

As we head into the general election season, it is very important that we offer the voters of South Dakota some great choices on the ballot in November.  We will be nominating candidates for the following statewide offices:
  • Attorney General
  • State Auditor
  • State Treasurer
  • Secretary of State
  • Public Utilities Commissioner
  • Commissioner of Schools and Public Lands
All serious candidates wanting to have their name entered into nomination for any of the above offices or had petitioned as CP primary candidates will receive complimentary admission into convention.

You MUST contact State Chairwoman Lori Stacey by June 10th (extended to June 17th) to have your name printed on our HAND-COUNTED paper ballots. An additional blank line for each office will be provided on ballot for write-in votes of any additional candidates entered into nomination at convention. ALL candidates will be entered into nomination from the floor.  The actual voting on nominations will be done by Constitution Party members only.  Voter registration forms will be available for guests wishing to join our party and participate in nomination process that are not currently CP members.

Full-steam ahead!!! Money bomb happening now........


Although we have had some temporary setbacks, we have good people working on these issues.  The smartest thing we can do now is to push forward in strength towards our state convention and the nomination of many strong and passionate candidates for November 2014.  

We will be having planning meetings for our upcoming state convention in which your participation is greatly encouraged.  The date has tentatively been set for June 21st, however, we are in search of a venue for this event.   You may participate in planning meetings via conference calls.  You will need to reply with your phone number if you wish to participate so that I can arrange the call.  In addition, we will start having monthly meetings in Sioux Falls at the main library which will be set-up in the coming week. 

Candidates for the following offices will be nominated at our state convention.  We need to provide South Dakota voters with a large slate of good Constitutionalist choices on the ballot in November.  A true Patriot does not retreat when times get tough; they forge ahead with even more vigor!

In addition, we are looking for leaders to become County Chairmen throughout South Dakota to help us organize and build our party. 

Some ideas being considered for convention if monies are raised to cover expenses would be to have a workshop/lecture series called "The Dirty Dozen: What every constitutional officer should know", taught by constitutional Attorney Richard D. Fry.

Petitioning crunch time is fast approaching!

ATTENTION ALL MEMBERS OF THE CONSTITUTION PARTY OF SOUTH DAKOTA

It is crunch time and many long-time members of the party have not signed petitions yet for gubernatorial candidate to get on the ballot. 

As you all know, we MUST get Curtis Strong on the ballot in order to retain ballot access in our state.  The Strongs have been working day and night on this effort and have brought over 90 brand new members into the CP.  It is time for all current members to sign these petitions so we do not lose our status as a party again in SD.

CP of South Dakota defends the constitution against a con-con with statewide tour

There are several announcements of upcoming events coming to a town near you.  First, we are disappointed to announce that the South Dakota for Freedom rally had to be postponed until late June or middle of July and will be at a different location in Rapid City.

Attorney Richard Fry will still be coming to South Dakota and will now be doing an entire speaking tour throughout South Dakota on March 7, 8 and 9. 


Richard will be speaking about the history and dangers of the push for a Constitutional Convention.

All members of the public are encouraged to attend this important speaking tour by one of America's true patriots, Attorney Richard D. Fry as we stand up to uphold, defend and work to restore the US Constitution across South Dakota.

We also encourage all CP members to come out and help us defend our constitution.  Curtis Strong, candidate for Governor, will be joining us and have his petitions available for your signature.  It is imperative in order to retain ballot access as a state party in South Dakota that we obtain enough signatures for a gubernatorial candidate to get on the ballot.

South Dakota for Freedom rally IS POSTPONED until June.

Unfortunately, we are going to be postponing the SD for Freedom event until after the primaries, the new date will be determined in the next few days and take place in June.

***Attorney Richard D. Fry will still be coming to South Dakota for a speaking tour of our state March 7,8 & 9.  Specific dates, venues and times to be announced shortly.  The purpose of his visit to our state is to discuss the dangers of a proposed Constitutional Convention.

It is IMPERATIVE that we get enough signatures on petitions to enable Curtis Strong to get on the ballot for Governor.  Many of you worked so hard in the past obtaining over 11,000 signatures in order to get our status back as a state party, once again, in South Dakota.  Now, we must have over 250 signatures of registered CP members and at least 2.5% of the vote in November in order to keep that ballot access as a party in the future. 

All of this nonsense is the direct result of the actions by R's and D's that have put UNCONSTITUTIONAL bills into "law" in order to strip away any resemblance of free and fair elections in America today.  We The People were supposed to enjoy complete freedom of ballot access for the average citizen, meeting just some very basic requirements to run for office. 

ALL meetings and speaking events will have Curtis Strong's petitions available for signature.  You can also download the below pages of petition to gather signatures in your area, just remember you MUST make the copies onto a 2-sided sheet of paper before obtaining signatures.

 If you are in the Sioux Falls or Rapid City areas, we will gladly run the petitions to you for your signature.

The Democrats and Republicans have been in leadership throughout our nation for well over 100 years, it is time for all Independents and all minor parties to unite and TAKE AMERICA BACK to THE rule of law, our US Constitution!  It is too late for them to apologize for over a century of their own failures.
